You hereby represent and warrant that you have the legal right to use the payment method(s) in connection with any purchase and that the information that you supply to us and to the third party payment processor(s) is true, correct and complete.

Third party purchases

As we talk about many third party products on the site, any purchase that you make following our links will be fully covered by the vendor of the product. We do not accept any liability for third party vendor’s policies.

Cancellation policy

We do not offer you the ability to cancel any purchases that you have made of the services and digital products offered on our site, if it’s not specifically stated along with the offer.

We reserve the right to cancel your purchase for any reason, at our sole discretion, including but not limited to fraud, inaccuracies, and unavailability of the items or services purchased. We will not provide you with any notice prior to cancelling your purchase.

If we cancel your purchase as stated above, we will issue you a refund of the full purchase price that you paid within 7 days from cancellation.

Refund policy

We firmly believe in and stand behind our products, but we understand that they may not work perfectly in every situation. We offer refunds on purchases made of the services and digital products offered on our site. To qualify for a refund, you must submit your request to us within 30 days of your purchase date by contacting us with your order details along with a valid reason for the refund.

We offer refunds at our sole discretion on any purchases of the services and digital products offered on our site for the following reason(s) only: the good, digital product or service failed to meet the warranties, if any, and wrong description.

Please note that we do not offer refunds for any other reasons other than those listed above. In some situations, we reserve the right to reduce the payment processing fee from the total refunded amount.

By purchasing any product from our site, you agree to the product refund policy and relinquish any rights to subject it to any questions, judgment, or legal actions.

Please be aware that when we issue a refund, we as the merchant do not receive the original processing fees back from payment processors (PayPal and Stripe). These fees can often exceed 5% of the transaction amount, depending on your the country and location of the purchaser. This results in a net loss for our business, and absorbing these costs significantly impacts our finances, so we appreciate your understanding. If the reason for your refund does not align with the valid reasons as outlined below, all processing fees will be deducted from the total refund amount.

Reasons we will happily refund your purchase

Product Issues: The product clearly does not work as described in the product details.
Support Resolution: There is a significant issue with our product that our support team was contacted about and given an opportunity to resolve, but cannot resolve within a reasonable time, making it unusable.
Change of Mind: The product works fine, but you’ve changed your mind and can prove you are no longer using our products or any included resources or offers.

Reasons we may hesitate and/or refuse to give a refund

Here are some scenarios where we might hesitate or refuse a refund:

Active Use: The product is still in use on your websites.
Product Removal: You have not provided proof that the product has been removed from your site.
Late Request: The payment was made more than 30 days ago.
Subscription Renewals: You ignored automatic renewal information but request a refund after the subscription has renewed. We generally do not offer refunds for renewals, but if we make an exception, processing fees will be deducted.
Outdated Software: You are using an outdated version of Divi, WordPress, or our product.
Server Issues: Your hosting server does not meet Divi’s recommended requirements or has issues beyond our control.
Feature Overlap: Updates to Divi may include features similar to those in our products. While we strive to keep our products innovative, refunds will not be issued simply because a feature becomes obsolete or redundant.
Lack of Cooperation: You refuse to work with our support team or do not follow instructions to give us access to your site.
Impulse Purchase: You did not thoroughly review the product description, view the demos, access the admin demo, read the documentation, or ask pre-sale questions before purchasing.
Frustration Outlet: You are seeking a refund out of frustration or as a reaction to a bad day or external factor unrelated to us.
Questionable Motives: You are attempting to deceive or scam us.

How to request a refund

If your request meets the criteria, please use our contact email (support @ vplsoft.com) to request a refund. Alwayss include the following information:

Order details: include order number (if available), date of purchase, the amount paid, and the detailed product title and description, if needed.
Refund reasons: please detail the reasons for a refund.
Your payment email (email used when paying the product) and contact data.

Once we have confirmed your details, the reason for the refund, and verified that the product is no longer in use, we will initiate the refund through your original payment method. You will receive an automated email from PayPal or Stripe.

Please note that once a refund is processed, the license keys (if any) will be deactivated, and access to updates, support, and downloads will no longer be available. If you need our products again in the future, feel free to reach out to us with any questions.

Support

We sell certain products such as plugins, themes or layouts, as is. There is no implied meaning that what we sell will function in your environment the exact way you would like it, ot that they are fully compatible with all 3rd party plugins and components you are using.

While we attempt to provide the best support possible for our products, we do not guarantee that any particular support query can, or will be answered to the extent, or within a timeframe, that the inquirer is completely satisfied. Technical support for plugins, child themes, and layouts sold and distributed on this site is only available for those who have purchased the product and can prove it within reasons, either by an active subscription or the purchase details.

Support and updates for our products are provided as long as we are actively in development.

Should any one of the following occur, we will no longer be responsible for providing support for our products:

We are no longer in active development
We are no longer in business, or were purchased or bought out by another company.
Divi is no longer actively developed.
WordPress is no longer actively developed.

No warranty on purchases

The items or services displayed or sold on this site are provided “as is”. No warranty, express or implied (including any implied warranty of merchantability, of satisfactory quality or fitness for a particular purpose or use) shall apply to any items or services displayed or sold on this site, whether arising by law, course of dealing, course of performance, usage of trade or otherwise.

Remedies

By using this site, you agree that the remedy for breach of this Terms of Service as it relates to your purchase shall be repair. You also agree that the remedy for breach of this Terms of Service as it relates to your purchase shall be to pursue dispute resolution as provided in the Jurisdiction and Venue and Governing Law sections below. These remedies intended to be your sole and exclusive remedies for any breach of this Terms of Service as it relates to your purchase.

Commenting and uploading content

Our own products

Many of the products we publish on the website are our own products, for which we either own the full ownership or the full reseller’s or agency license. In later case we bought the license to sell the products from the original owner and can prove it anytime.

We directly support our own products only, in all other cases the owners are responsible for support.

Such products are subject to removal and price changes at our own discretion.
